FEDERAL GOVERNMENT & VFBV REVEAL PLAN TO FURTHER INTEFERE WITH CFA OPERATIONAL STAFF EBA (YOUR CONDITIONS OF EMPLOYMENT)

Following the amendment made to the Fair Work Act last month, which gives volunteers/ third parties the right to interfere with enterprise agreements, the Minister for Industrial Relations, Michaelia Cash, has outlined how the government intends to use the newly amended Act to interfere with the certification of the proposed CFA Operational staffing agreement.

Members would be aware that Andrew Ford from the VFBV on behalf of the VFBV and CFA Volunteer Brigades worked very closely with Michaelia Cash and the Liberal Party during the federal election where as in response the liberal party was to introduce unprecedented rights to the VFBV to interfere with your conditions of employment.

The CFA Board and State government endorsed the proposed CFA Operational Staffing EBA 2016 earlier this year.

Since such time the VFBV have initiated Supreme Court actions to prevent the agreement going for a vote and to seek to strike out a substantial number of the clauses which were agreed to over a lengthy period of negotiations.

Latest Developments

The CFA have recently received correspondence from Federal Minister Michaelia Cash’s legal representatives stating that if the proposed EBA is put to the Fair Work Commission for approval they will apply to have the Full Bench of the Fair Work Commission hear the application and make a submission opposing approval of the proposed agreement.

Additionally the Liberal/National Government will seek to have a substantial number of your clauses and entitlements declared invalid.

The letter from Michaela Cash’s legal representatives lists 60 terms in the proposed agreement that they allege are unlawful under the recently amended Act.

This comes on the back of a similar list that the VFBV have provided which lists the 45 clauses and 9 schedules in the proposed agreement that they believe impact on volunteer firefighters.

  • Rostering
  • Minimum Staffing Levels
  • Consultation
  • Dispute Resolution
  • Classifications, Career Paths and Opportunities
  • EMR
  • RAR
  • Secondment and Lateral Entry
  • Schedule 1 – Minimum Crewing Chart
  • Schedule 5 – Training Framework

The UFU has been in extensive discussions with its legal counsel with a view to fully understanding the potential attack on your conditions of employment and to advise accordingly on strategies.

Delegates telephone conferences will be facilitated in the near future and a full explanation as to the above matter and the status of both CFA and MFB bargaining will be provided at the members meeting on Monday.
