CFA OPERATIONAL STAFF BARGAINING
UFU CHALLENGES FWC DECISION
Today the UFU filed an appeal against part of the Fair Work Commission’s decision that two clauses in the UFU log of claims for the CFA Operational Staff negotiations were caught by Re: AEU principles.
Members were notified on Tuesday that the Fair Work Commission handed down a bargaining decision which in part found two UFU clauses in its claim for the CFA Operational Staff negotiations relate to staffing and were caught by Re: AEU principles.
Deputy President Smith expressly referred to the UFU Appeal of the Recruits Decision and the fact that his Decision may be affected by the pending decision of the Full Bench of the Federal Court in the UFU’s Recruit Case Appeal. In doing so DP Smith also expressed that he shared Justice Murphy’s reservation about the application of the Re: AEU principle in circumstances where the parties reached an agreement and this point is central to the UFU Appeal of the Recruits Case.
The UFU today filed an Appeal and also sought a stay of the part of the decision that essentially required the UFU to remove those two clauses from the log of claims. The UFU’s application to stay that aspect of the decision will be heard on Wednesday.
