UFU AND CFA AGREE 170 NEW POSITIONS
TO BE ADDED INTO THE
MINIMUM STAFFING SCHEDULE
MEMBERS MEETINGS WILL BE HELD

As a result of the successful Full Bench Federal Court Appeal by the UFU, the CFA will now have to vary the staffing schedule to increase the minimum staffing by 170 positions.
Please note the 170 positions are separate to the Government commitment of an additional 450 CFA and MFB firefighters. Members should also be aware these are new positions and are not positions due to attrition.
Today in the Fair Work Commission the UFU and CFA agreed a total of 170 new positions are to be included in the Staffing Schedule.
Currently the CFA is required to maintain no less than 99 firefighters on shift and once varied the CFA will be required to maintain a minimum of 133 on day shift and 132 on night shift.
The UFU will shortly notify members of meetings to discuss the variation to the Staffing Schedule in preparation of a vote which will be conducted by a ballot by the AEC in the next few weeks.
The CFA UFU Operational Staff Agreement 2010 provided for the minimum staffing schedule to be varied each year to include all new positions created in that year but in 2012 the CFA refused to do so.
The matter was arbitrated in 2012 with Commissioner Roe finding there was an obligation to vary and ordering the parties to go through the required process. The CFA appealed and that appeal was adjourned pending the constitutional arguments being determined in the “Recruits Case” which was ultimately determined by the Full Bench of the Federal Court.
Last week the CFA withdrew their appeal of Commissioner Roe’s decision and the parties met in conference before the Commission today and agreed that the 170 positions that have been created since 2011 are to be included in the staffing schedule.
In addition to the 170 firefighter positions, 9 Operations Officer positions have also been created since 2011.
The variation will include four Station Officer Positions that have been created in Mildura but are yet to be filled. The agreement today includes the UFU and CFA agreeing to a process to have those positions filled no later than October 2015.
The UFU will notify members shortly of meetings to discuss the variation in preparation of a vote which will be conducted by the AEC in the next few weeks.
