FEDERAL COURT DECISION
As advised this afternoon, Federal Court Justice Murphy today handed down his decision regarding the CFA staffing numbers.
Further to the earlier Bulletin, the UFU has advised delegates via a telephone conference of further details and the various strategies in place.
The subject matter of this case is legally very complex and detail will be explained further in the near future.
A particular point to note is that the CFA did not succeed in all claims. The CFA were not successful in their attempt to invalidate the consultation and dispute provisions as well as the allowance clause/reserved matters clause.
In relation to other matters such as staffing, contracting out, lateral entry, these are all provisions that are captured by the common law Deed and the CFA have not challenged the validity of such Deeds.
Additionally, the decision regarding staffing, lateral entry and contracting out is being reviewed by the UFU respected legal team and we will provide more information when it comes to hand.
