UFU MEMBERS ENCOURAGED

TO ATTEND HEARING OF THE MFB APPLICATION TO TERMINATE OPERATIONAL AGREEMENTS

The MFB’s application to terminate the MFB UFU Operational Staff Agreement 2010 and the MFB UFU ACFO Agreement 2010 has been set down for a 20-day hearing in the Fair Work Commission.

All members are encouraged to attend the hearing in the Fair Work Commission whenever they can so that members hear first-hand  MFB’s witnesses give  evidence in support of MFB’s application  to abolish the enterprise agreements and UFU’s witnesses opposing the application.

The Commission can only determine to terminate the entire agreement, or not to terminate it at all.  The Commission does not have the power under this application to only terminate parts of the agreement or vary clauses.  Any evidence in support of the MFB’s application is evidence to support terminating the entire agreements.

A large number of MFB firefighters are providing witness statements opposing the application and clearly putting their views including the significant detrimental impact if their terms and conditions of employment were to be wiped out.  

The view of members affected by the application to terminate the agreements is an key consideration for the Fair Work Commission when determining the matters.  

This is the most significant of attacks MFB firefighters are facing.  

If the Agreements are terminated the operational staff protections will be reduced to minimum conditions as set out in an applicable award or set in national employment standards and minimum wages.  The MFB has said it will provide an undertaking to maintain some conditions but the content of such an undertaking, if it is made, is not known.

A strong presence of UFU members at the Commission during the hearing will be a great support to your colleagues giving evidence and will give an insight in to the MFB’s approach to its employee relations.

The hearing will be held at the Fair Work Commission, 11 Exhibition Street, every week day from Monday 7 July 2014 to Friday 1 August 2014.  

Below is a list of each hearing day and the shift on day duty.  Anyone not on duty on the hearing days are strongly encouraged to attend the Fair Work Commission whenever they can.  You will be contacted by your delegates in the near future.
