REQUEST FOR OVERTIME BY

ESTA

There have been differences across sites over what is applied when ESTA require an employee to attend work on a rostered day off.

The Enterprise Agreement applies to all operational employees at all sites.

Regardless of the reason, (Team Leader meeting/Focus Group) or the duration of the required time (1 or 2 hours) the following clauses apply:

23.3 An employee recalled to work overtime after leaving work shall be paid a minimum of 4 hours at overtime rates. Provided that an employee requested to commence a shift early, shall be paid overtime only for the hours worked prior to the normal shift commencement.

23.6 An employee may elect to take time off normal rostered duty in lieu of overtimesubject to the following:

a) the time off granted would be no more than the actual time worked;  

b) an employee may take a maxi mum of 2 days at a time;

c) an employee may bank a maximum of 4 days/shifts in total; and

d) the time off taken at a time agreed between the employee and the relevant manager, and must take into consideraration operational requirements.

The granting of time off will not be reasonabley refused.

 

For the avoidance of doubt, the fact that ESTA have to pay minimum 4 hours at overtime rates, does not mean you are required to attend work for 4 hours on your day off.

Secondly, you may elect to take time in lieu of overtime. ESTA does not elect this for you.
