FULL BENCH TO HEAR UFU APPEAL OF RANK ALIGNMENT AND RELATIVITIES CASE IN OCTOBER
- The UFU Appeal of the MFB CFA rank alignment and relativities case has been set down to be heard by a Full Bench on 19 October 2018.
- The UFU is appealing the Fair Work Commission Decision that the UFU did not have jurisdiction to argue the MFB CFA rank alignment and relativities matter.
- Members are reminded that the MFB and CFA Boards agreed to these provisions in the 2016 Agreements and have been involved in conciliation on this matter since the UFU filed the disputes in October 2017.
- Despite the MFB, CFA and the Government agreeing not to run a jurisdictional argument the MFB and CFA not made an eleventh-hour challenge on the technical legal issue of the Fair Work Commission’s jurisdiction, without regard to all the time and money on both sides that has been spent trying to resolve this dispute in the Commission to date, which is industrial bastardry at its finest.
