UFU INSTRUCTS LAWYERS TO WRITE TO HERALD SUN AND COMMISIONER LAPSLEY FOR RETRACTION AND APOLOGY
As of today, the Union’s lawyers have served notices on the Herald Sun and the Emergency Management Commissioner.
You are all aware the Herald Sun published articles that contained comments that are false, misleading and defamatory in relation to the UFU’s Dispute notification regarding the MFB’s proposed “Scenario Availability” Roster.
These comments are offensive to all firefighters as they imply that firefighters were ordered not to attend work when Victorian lives and property were likely to be at considerable risk due to the heightened fire danger.
Not only were these offensive articles published prior to the FWC hearing but also after the FWC hearing despite a Herald Sun journalist being present at the FWC when the Union’s Counsel Mr Warren Friend QC clearly stated that these allegations were false.
Despite knowing the allegations had no substance the Herald Sun went ahead and published the defamatory articles.
As a result of these comments the Union has instructed its lawyers to write to both the Editor of the Herald Sun and Commissioner Lapsley seeking amongst other things, a retraction and a full written apology. If a retraction and apology are not provided legal proceedings are foreshadowed to seek damages.
We will keep you informed of the outcome of these complaints.
