OVERTIME ISSUES & LDF TRIAL

Some confusion has arisen as to how overtime on a public holiday is paid in respect to the payment of public holiday days in lieu. To clarify the situation for members, all shift workers are entitled to a day’s pay in lieu should they not be rostered to work on a public holiday. If you work overtime on a public holiday, you have worked on this day and this day in lieu is not payable. However, due to ESTA requiring an incentive for staff to work overtime on these days they have agreed that they will still pay the day in lieu payment if you work no more than 8 hours overtime. Why would you?

Note: Table is for an EKO Full Time Police Employee, part timers and non-EKO employees will have less hours paid for their Day in Lieu. Days in Lieu are calculated as per your standard sick leave deduction and/or pro-rata hours for part timers.

Overtime and Working from home.

Despite what some of you have been informed, the unions have not endorsed the notion of online training in your own time at home. There are some issues that need to be considered. It starts as a “one-off” but where does it end? The flood gates are open. Secondly, there is no form of assistance with online training when and if it is required at home. Finally, if you are asked to perform work from home as overtime, it should be paid as per the Enterprise Agreement clause 23.3. A minimum of 4hrs overtime is paid if you are recalled to work overtime. Location is irrelevant. Do not accept an incentive payment of 2hrs overtime.

LDF TRIAL

The unions met with ESTA regarding the LDF trial. There are differences between the parties on 3 major issues:

* Remuneration

* Flexibility with hours of work. and;

* Which Enterprise agreement is most appropriate, that is, the Operations EA or the Admin/Support EA.

Given the trial ends in 3 weeks and ESTA did not have a report to provide with their recommendations, we sought an extension of time until the unions are provided their proposal for our consideration.
