UNIONS RELIST SECTION 240 AT FWC FOLLOWING 4 MONTH DELAY BY GOVERNMENT
As members would be well aware the Unions and ESTA reached in principle agreement on a new EBA for ESTA Operational Employees in October 2015.
As advised at the time, following reaching in principle agreement the EBA was required to go through a certification process inclusive of an internal government process followed by a vote of employees.
The UFU is extremely disappointed that Government has now taken 4 months and is delaying members right to vote on your enterprise agreement and the agreement coming into effect.
Despite repeated requests from the Unions as to status, ESTA still seems unable to provide a clear answer as to when Government will complete their process.
As such, the Unions have contacted the Commission seeking a re-listing of our bargaining dispute and requested the attendance of both ESTA and the relevant government representatives to provide an update before the Commission as to the delay.
This matter has been listed for 4.30pm next Thursday 25 February.
Members will be kept informed as to the outcome.
Should Government and ESTA continue to delay in this process the Unions will consider what further action is necessary including reinstating protected industrial action.
It is worth remembering that the a pre-election commitment of Premier Andrews promised that public sector enterprise agreements would flow through government approval processes within 2 months. This appears to be another election promise broken by the Andrews Government, we will be writing to the Premier on this issue.
